The Law of the Republic of Uzbekistan “On Public Civil Service” of 2022 treats diplomatic personnel as civil servants and exempts them from only two of its provisions, those on qualification ranks and remuneration. The special rules that this choice presupposes are scattered across two laws of 1992, the Consular Charter of 2019 and presidential acts, some of which are unpublished. Uzbek scholarship has studied diplomatic and consular institutions mainly from the standpoint of international law, and the individual service status of their employees has received less attention. The article examines which differences between the status of a diplomatic employee and that of a civil servant are legally significant, what accounts for them and which of them call for special regulation. Using formal-legal, doctrinal and functional comparative analysis of Uzbek legislation, the Vienna Conventions of 1961 and 1963 and the legislation of Russia, Germany and the United States, the two statuses are compared across twelve elements. Four criteria for special regulation are proposed: functional necessity, insufficiency of the general rule, personal and temporal limits, and proportionality supported by corresponding guarantees. Applied to the current law, the criteria confirm the exemptions for ranks and pay, show that the general rule on working time is adequate, and identify six matters requiring statutory rules: rotation, postings abroad, property abroad, joint postings of spouses, termination of postings and family guarantees. We argue for a special statute within the civil service, with the general law applying subsidiarily, and formulate proposals de lege ferenda.
