MEDIATION IN LABOR DISPUTES: A COMPARATIVE ANALYSIS OF UZBEKISTAN, THE USA AND THE MIDDLE EAST

This article presents a comparative legal analysis of mediation in labor dispute resolution across Uzbekistan, the USA, Turkey, and the UAE. The methodology integrates comparative legal analysis, formal-legal examination of normative acts, and statistical analysis of mediation practice. The central hypothesis holds that mediation effectiveness is primarily determined by institutional support, professional mediator training, and voluntary participation. Key findings: the USA has a mature institutionalized mediation system (FMCS); Turkey and the UAE operate mandatory mediation models with strong performance metrics; Uzbekistan is at an early infrastructure-building stage. Based on the analysis, legislative, institutional, and methodological recommendations are formulated to improve labor dispute mediation in the Republic of Uzbekistan.
