The article analyzes the concept of «offender», the difference between the concepts of «subject of the crime»? from the criminological concept of «person who committed a crime», the concept of «guilty», «the convict», «the person who committed the crime,» «a person is guilty of a crime», «guilty party,» «a person is guilty of a crime», «age», «sanity», the intentional or reckless Commission of the offence, the liability of natural and legal persons, legal characteristics of the perpetrator, qualifications, torture, done by any individual or group of individuals, the article analyzes the minimum age of criminal responsibility, the time of committing a socially dangerous act, forensic psychiatry, and the allocation of insanity according to two criteria: 1) the medical (biological) criterion, 2) the legal criterion and the identification of two features of the legal criterion: a) intellectual (mental) and b) volitional
