The article analyzes the limitations of civil liability for delayed, incomplete, or improper fulfillment of obligations. Additionally, it examines the main trends in legislation and judicial practice of the USA, England, France, Germany, and other foreign countries. Based on the experience of foreign legal systems, the article discusses comprehensive approaches to improving national legislation. When considering civil liability for damages resulting from non-fulfillment of obligations, the study explores: objective approaches to decision-making; clarification of sanctions for non-fulfillment of obligations; improvement of damage compensation procedures; application of financial sanctions by courts in cases of non-fulfillment; factors determining financial liability; and mechanisms for compensating damages not only financially, but also psychologically and morally. Furthermore, the article analyzes the experience of national judicial practices in foreign countries regarding the application of civil liability forms by courts. It also provides recommendations for the implementation of liability application by courts.
