Improving the legal framework for ensuring personal inviolability in criminal proceedings

Annotatsiya

This article analyzes the constitutional, criminal-procedural, and international legal foundations for ensuring the personal inviolability of individuals within criminal proceedings. Examining personal liberty and inviolability as fundamental guarantees in criminal proceedings, the study highlights the importance of the principles of legality, necessity, proportionality, and judicial oversight in the application of measures such as detention, arrest, house arrest, searches, and other procedural coercive measures. The research conducts a comparative legal analysis of the Constitution of the Republic of Uzbekistan, the Criminal Procedure Code, documents from the Plenum of the Supreme Court, and international human rights standards. Based on the findings, proposals have been developed to further improve mechanisms for ensuring personal inviolability, strengthen judicial oversight of procedural coercive measures, enhance the effectiveness of defense counsel participation from the initial stages, and develop mechanisms for the prompt restoration of rights that have been unlawfully restricted.
