This article examines emerging forms of cybercrime committed through artificial intelligence and modern digital technologies, their legal nature, and the challenges of developing an effective legal framework for combating such crimes. It argues that, under digital transformation, cyber threats are moving beyond conventional information-security incidents and acquiring autonomous, adaptive, and transboundary characteristics. The reduced level of direct human involvement, autonomous decision-making, automated vulnerability detection, and algorithmic circumvention of security mechanisms create new challenges for identifying criminal subjects and establishing individual guilt. The article focuses on the legal qualification of AI-enabled cybercrimes, the procedural admissibility of digital evidence, attribution of criminal conduct, and determination of liability for damage caused by autonomous AI systems. The study proposes the development of an algorithmic liability framework, recognition of the use of AI as an aggravating circumstance in the commission of certain crimes, mandatory cryptographic verification of digital evidence, and the establishment of a special legal regime for AI systems as sources of increased risk.
