This article provides a legal analysis of the constituent elements of the crime of illegally organizing and conducting gambling and games of chance. The article explores the adverse impact of illegal gambling activities on public order, the moral foundations of society, public health, and economic relations. It further substantiates the formal nature of the corpus delicti, clarifies the legal meaning of the concepts of “organization” and “conduct,” highlights the significance of administrative prejudice as a prerequisite for criminal liability, and analyzes the specific characteristics of offenses committed through telecommunications networks and the Internet.
