This article discusses provisions of the legislation of the Republic of Kazakhstan, the Republic of Uzbekistan and several foreign countries that regulate relations between business participants of electronic commerce using electronic documents. Currently, e-commerce is actively developing all over the world, becoming more diverse and larger. E-commerce is constantly undergoing numerous changes and this, of course, forms an incentive to be even more interested in e-commerce. E-commerce is an essential part of e-business. The main legal principle of e-commerce is that the parties of a contract have no right to question the validity and bindingness of the contract just because it is concluded in electronic form. Currently, the Republic of Kazakhstan does not have a Law "On Electronic Commerce" and its adoption will make it possible to determine the legal status of suppliers, consumers, the procedure required to conclude a contract or to cancel erroneous orders, etc. The purpose of creating special rules is to provide legal guarantees to all participants of e-commerce activities. Therefore, adoption of E-Commerce Law is essential for the sake of successful development of electronic commerce in the Republic of Kazakhstan, and that will facilitate integration of the Republic of Kazakhstan into the global open e-market and perception of the specific provisions of this type of activity.
