The article examines theoretical views on procedural problems of constructive resolution of issues to be clarified in a criminal case submitted to the court, critically and in detail examines the procedural prerequisites and the possibility of optimal implementation of the institution of preliminary hearing, analyzes the positive results of the functioning of this institution in foreign practice, comprehensively discusses algorithms his actions and his influence on the implementation of procedural functions by the participants in the criminal process.
