The article deals with the problems that are the subject of many years of discussion about the further prospects of the stage of initiating a criminal case. Based on the results of previous studies on the problems of pre-trial proceedings, the authors are trying to identify the true reasons for the emergence of the stage of initiation of a criminal case. As a result, it is concluded that the question of the further fate of the stage of initiation of a criminal case can be resolved only in the context of a clear understanding of the prospects for further development of the entire system pre-trial proceedings.
