The article analyzes the problem of evidence in case of invalidation of a departmental normative legal act on the basis of theoretical views and current legislation. In particular, the concept, types and characteristics of evidence are described. Emphasis was placed on issues that need to be investigated by the courts. Proposals were made to improve the legislation.
