This scientific article examines modern administrative and legal mechanisms for the implementation of the right to receive qualified legal assistance guaranteed by Article 29 of the Constitution of the Republic of Uzbekistan. Through a comparative analysis of the historical evolution of the institution of state-funded free legal aid (hereinafter referred to as SFLA) and foreign theoretical approaches (CIS and Western models), the author conducts an in-depth study of recent digital reforms in national legislation. The main focus of the research is on the practical effectiveness of the “On the provision of legal aid at the expense of the state” information system introduced by the 2023 Law of the Republic of Uzbekistan “On approval of the regulation on the procedure for engaging and remunerating lawyers providing legal assistance at the expense of the government” and the 2024 Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 774 “On Approval of the Regulation on the Procedure for Engaging Lawyers to Provide State-Funded Legal Aid and Remunerating Their Services”. The article analyzes, in a critically sharp (polemical) spirit, urgent systemic problems arising during digitalization: logistical errors in the “territoriality” principle, bureaucratic payment barriers linked to the Single Registry of Social Protection, and the transformation of the corruption risk known as “pocket lawyers” into a new form. Based on the analysis results, concrete scientific and practical proposals for improving the SFLA system have been developed. In particular, the necessity of integrating a “Smart allocation” algorithm (geolocation and load balance) for the automatic assignment of lawyers, as well as introducing the institute of “Subsidiary payment guarantee” (priority of the procedural decision) in the payment system, is substantiated. These proposals serve to genuinely ensure the constitutional guarantees of achieving justice in the country.
