In detailed study of the practice of consideration by arbitration courts of disputes related to the conduct of negotiations, it is possible to highlight the criteria for good faith behavior of participants in negotiations on conclusion of the agreement. One of the most significant is case № А40-98757/2018 in case of Pletnev P.S. (plaintiff) to Univers-Akva Ltd. and Universal-Akva Ltd. (defendants). This article examines the criteria for determining the scope of good faith behavior of the parties to negotiations on the conclusion of contracts on the example of the above mentioned case.
