This article analyzes the new digital era that has transformed the concept of methods and means of production. Today, according to the author, the introduction of artificial intelligence and robots in the economy is becoming inevitable, while the degree of human influence on the course of the production cycle is gradually decreasing and replaced by programs that determine the behavior of robots and the way of thinking of artificial intelligence using digital algorithms. At the same time, today on the agenda is the legal assessment of the nature of artificial intelligence, and the regulation of the procedure for its use. In this regard, the article analyzes possible approaches to disclosing the issues of legal responsibility of artificial intelligence as a participant (executor) of functions in corporate relations. In this article is being studied the possibility of recognizing the properties of a subject of law in a robot (machine) with artificial intelligence, and considered the possibilities as well as ways of recognizing the legal personality of artificial intelligence in cyber-physical space. In addition, the author identified mechanisms for bringing robots to legal responsibility, and forecasted short-term, medium-term and long-term prospects for rule-making in the field of establishing the legal capacity and responsibility of artificial intelligence.
