In the article the author analyzes “Avesta” as a legal monument, and seeks to demonstrate that its study from the standpoint of legal anthropology has the most productive moment, because it focuses on the genesis of legal norms in society, the legalization of social life of ancient society. The author adheres to the Khorezm theory of the origin of the Avesta, referring to the fact that Ahura-Mazda came to Zarathustra in the territory of Khorezm. From the standpoint of legal realism, the Avesta was an early source of law, in which there was a symbiosis of religion, morality and legal norms with a firm priority of religious canons, which were closely intertwined with the morality of the Zoroastrians.
