The article discusses the theoretical foundations of the recognition of a commodity penalty as a way to ensure the fulfillment of obligations, its appearance and the advantages of its application. It also sets out the forfeit rules established by law and applied in judicial practice. In addition, proposals were made to improve the provisions of the Civil Code of the Republic of Uzbekistan concerning penalties.
