Annotatsiya

The article analyzes the formation of obligations arising from unjust enrichment, its meaning, categories, approaches to it in legal systems, as well as the opinions of our foreign and domestic scientists. In modern developed legal systems, several approaches to the obligation to return illegally acquired property have been formed, which are also expressed in the adoption of a modified or classical form of the rules established in Roman law, or mixed forms, including various mechanisms. The secondary, additional (subsidiarity) of this design lies in the essence of the original approach to the return of unjustified wealth. At the same time, the article discusses the types of claims that can be applied for unjust enrichment and their differences.
