Maqolada insonning asosiy huquq va erkinliklarini taʼminlashda davlatning majburiyatlari mustaqil konstitutsiyaviy-huquqiy kategoriya sifatida tadqiq etiladi. Konstitutsiyaviy huquq bilan davlat majburiyati oʻrtasidagi korrelyativ va funksional bogʻliqlik, negativ va pozitiv majburiyatlar nisbati, inson huquqlari doktrinasida shakllangan “respect-protect-fulfil” modeli hamda uning metodologik ahamiyati tahlil qilinadi. Mazkur modelning mazmun-mohiyatidan kelib chiqib, davlatning inson huquqlarini ta’minlashga doir majburiyatlarini tegmaslik, muhofaza qilish va profilaktika, normativ-institutsional, protsessual hamda himoya-tiklash majburiyatlariga ajratish taklif etiladi. Davlatning konstitutsiyaviy majburiyatlarini baholashda esa qonuniylik, majburiyat subyektining aniqligi, qat’iy muddat, yaroqlilik, yetarlilik, oqilonalik, mutanosiblik, samaradorlik hamda shaxs uchun real huquqiy natijaga erishish mezonlaridan foydalanish asoslanadi. Yangi tahrirdagi Konstitutsiya negizida inson huquqlarini taʼminlash davlat organlari faoliyati mazmun va chegaralarini belgilovchi konstitutsiyaviy majburiyatlar tizimi ekani ochib beriladi.
