The article analyzes the procedural features of the use of the institution of mediation in resolving civil and economic cases. A comparative legal analysis of the procedural legislation of foreign countries, such as the USA, Germany, Japan, Russia, Belarus, Kazakhstan, regarding the use of mediation was also carried out. According to the results of the study, a conclusion was made to determine the range of civil and economic cases in national legislation for which mediation should be applied, and to develop mandatory procedural mechanisms for the execution of a mediation agreement in cases of its non-fulfillment in a voluntary basis, as well as to reduce the time of suspension of proceedings in the case when concluding an agreement on the application of mediation procedures.
