In this article discussed the distinctive features of labor relations from similar civil legal relations. In particular, important rules, the necessity and procedure for concluding a labor contract, as well as mistakes made by employers when concluding a labor contract are analyzed. Based on the important principles of protecting the rights of workers and taking into account the requirements of a modern market economy, found: the importance of regulating labor relations by fixed-term labor contracts; differences from the contract for the provision of services and from the work contract, regulated by civil law. In addition, the advantages and disadvantages of concluding fixed-term labor contracts, as well as problems arising in law enforcement practice, were studied. Particular attention is paid to the expansion of the rights of the employer when concluding fixed-term labor contracts. Based on the legislative experience of such developed countries as Germany and France, recommendations are proposed for improving the legislation governing labor relations.
