Основным принципом римского права являлось признание силы права только на будущее, причем к ранее возникшим юридическим фактам и отношениям необходимо применять прежние нормы, т.е. «leges et constitutionis futuris certum est dare formam negotiis, non ad facta praeteria revocari». В Средние века считалось, что преступники не имеют права требовать применения к ним тех или иных законов. Хотя принцип законности был разработан как идея в эпоху Просвещения, в начале XIX века именно Фейербах преобразовал его из идеи в многоаспектный принцип, создал особое правовое учение.
