This article provides a theoretical and practical analysis of the essential characteristics of the subject of the crime of intentional destruction or damage of property. In particular, the concept of the criminal subject is examined with a scientific approach, highlighting key attributes such as the age of criminal responsibility and the criterion of sanity. Within the framework of Article 173 of the Criminal Code of the Republic of Uzbekistan, the age characteristics of persons committing this crime and the criteria for their criminal liability are studied. Statistical data show that the share of such crimes committed by minors is relatively low. The author demonstrates the interrelated nature of medical-biological, socio-psychological, and legal criteria in determining the age of criminal responsibility, and thoroughly analyzes the role and significance of these factors in shaping the concept of the criminal subject. The article also examines the general and special age limits of criminal responsibility established by the norms of the Criminal Code of the Republic of Uzbekistan for certain types of crimes, as well as the procedures for determining the age of minors and related procedural features. Research results indicate that minors account for a relatively small proportion of these offenses, particularly in the 14–16 age group. Accordingly, there is no need to lower the age of criminal responsibility, and the current approach is justified both scientifically and practically. The article also offers the author’s perspectives on certain theoretical issues related to the criminal subject.
